Press Release: KJI statement on religious gatherings, Gov. Kelly EO 20-18

April 8, 2020 –  Earlier today, Sam MacRoberts, litigation director and general counsel of Kansas Justice Institute, sent a letter to Gov. Laura Kelly regarding Executive Order 20-18. The letter raises constitutional concerns on the substance of EO 20-18. The Legislative Coordinating Council also received the letter.

“The Governor’s latest executive order is unconstitutional, in our view. We can flatten the curve and protect our liberties at the same time. These goals aren’t mutually exclusive,” says KJI Litigation Director Sam MacRoberts.

MacRoberts authored an op-ed in the Topeka Capital-Journal last week that discussed orders of this nature. His piece outlined why the details of executive orders matter a great deal and specifically discussed a hypothetical order that limited religious gatherings while providing continued operation of shopping malls.

UPDATE: The Legislative Coordinating Council has overturned the governor’s Executive Order 20-18, which was supposed to start today at 12:00 P.M.
